ENS Advertiser Centre – Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the ENS Advertiser Centre, a service provided by ENS ("we", "us", or "our"). By accessing or using the advertiser platform, you ("Advertiser", "you", or "your") agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, please refrain from using the service.
1. Eligibility
To use the ENS Advertiser Centre, you must be at least 18 years of age and authorized to represent a business, organization, or yourself as an individual advertiser.
2. Account and Access
- You are responsible for all activities conducted through your advertiser account.
- You agree to provide accurate, current, and complete information when registering or submitting ads.
- You are responsible for maintaining the confidentiality of your account credentials.
3. Ad Content and Approval
- All submitted advertisements are subject to review and approval by ENS before publication.
- We reserve the right to reject, suspend, or remove any advertisement that violates these Terms or does not meet our content standards.
- Advertisers must ensure that their ads do not:
- Contain misleading, false, or deceptive content
- Infringe on copyrights, trademarks, or other intellectual property rights
- Promote illegal products, violence, hate speech, or adult content
- Include malware, scripts, or unsafe redirects
4. Ad Formats and Placement
ENS provides multiple ad formats including banner ads, native ads, pre-roll video, popunders, fullpage takeovers, and push notifications. ENS reserves the right to determine the placement, frequency, and presentation of your ads across its platforms.
5. Payment and Billing
- Advertisers must pre-pay for campaigns unless otherwise agreed in writing.
- Payment options include Mobile Money, ENS Wallet, or other supported payment methods.
- All payments are non-refundable unless an ad fails to run due to an error or fault on our side.
6. Campaign Performance and Reporting
- ENS provides basic performance metrics including impressions, clicks, and engagement data.
- ENS does not guarantee specific results, performance, or ROI for any campaign.
- Performance data is provided for informational purposes only and should not be relied upon as a sole basis for decision-making.
7. Intellectual Property
- You grant ENS the right to display, reproduce, and distribute your submitted ad materials on its platforms for the duration of your campaign.
- ENS retains all rights to its brand, platform, and advertising infrastructure.
8. Limitation of Liability
ENS shall not be held liable for:
- Any direct or indirect loss arising from ad performance, platform downtime, or user interaction
- Content submitted by third-party advertisers
- Technical issues outside of our control, including third-party service outages
9. Termination
- ENS reserves the right to terminate or suspend your advertiser account without prior notice if you violate these Terms or applicable laws.
- You may terminate your advertising activity at any time, but no refunds will be issued for partially served campaigns.
10. Changes to Terms
We may modify these Terms at any time. Changes will be communicated via our platform or email. Continued use of the advertiser service after changes are published constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Uganda. Any disputes shall be resolved under Ugandan jurisdiction.
